Welcome to Lumi, operated by YourSpace LLC ("we," "us," or "our"). These Terms of Service govern your use of all Lumi platforms, including Lumi Academy (lumi-academy.org), Lumi High (lumi-academy.org/high), and Lumi Lingo (lumi-academy.org/lingo), as well as any associated mobile apps (collectively, the "Services"). By accessing or using any Lumi platform, you agree to these Terms. Please read them carefully.
Lumi Academy is designed for children ages 5–14 under the supervision of a parent or guardian.
Lumi High is designed for students in grades 9–12 (approximately ages 14–18) under the supervision of a parent or guardian.
Lumi Lingo is a language-learning app for learners of any age, used under the supervision of a parent or guardian account for anyone under 18.
Accounts must be created by a parent or guardian who is at least 18 years old. By creating an account, you confirm that you are the parent or legal guardian of any student using the service.
You confirm that the information you give us is accurate, that you are at least 18, and that you have the legal authority to agree to these Terms for yourself and for the children in your household. You may not use Lumi if we have previously ended your access for breaking these Terms, unless we agree in writing. Lumi is offered only to people in the United States unless we say otherwise for a specific product.
Lumi Academy and Lumi High are offered as informal, supplemental educational entertainment platforms. They are provided as learning companions only, and nothing in either platform constitutes formal instruction, tutoring, or academic advising. Neither Lumi Academy nor Lumi High is accredited by any federal, state, regional, or private accreditation authority. Completion of content on either platform does not constitute an official grade, academic credit, diploma, transcript, certificate, or any academic qualification recognized by any institution or employer. Do not rely on either platform as your sole homeschool compliance mechanism — parents are solely responsible for complying with their state's homeschool registration and reporting laws.
Lumi is a learning tool, not a school. Lumi is not accredited, does not issue accredited diplomas or transcripts, and is not a substitute for a teacher, tutor, doctor, therapist, lawyer or other professional. We do not guarantee any educational result, grade, test score, readiness for any grade, acceptance by any school, college or employer, or compliance with any state's homeschool, attendance, testing or reporting rules. You are solely responsible for knowing and following the laws that apply to your child's education, including recording progress and meeting your state's requirements. Reports, certificates, credentials and records Lumi produces are tools to help you and are not official documents unless an authority says they are. Crafts, science, cooking, outdoor, shop and similar activities involve physical risk; you are responsible for supervising your child and deciding whether any activity is safe and suitable.
Lumi platforms, including Lumi Lingo, are designed to be used by children only under direct parental supervision and through a parent/guardian account. We do not knowingly collect personal information directly from children under 13. By creating an account, you represent that you are a parent or legal guardian (18+) creating the account on behalf of your child(ren). All data associated with child profiles is entered by you, the parent, and you are solely responsible for supervising your child's use of the Services. Children cannot buy anything in Lumi: purchases, spending limits and Jobs approvals are made by the parent through the parent account. If you believe a child under 13 has provided personal data without parental consent, contact us immediately at the address below.
You are responsible, not Lumi. Lumi is for use by children only through and under the supervision of a parent or legal guardian. By creating or using an account you accept full and sole responsibility, as between you and YourSpace LLC, for everything that your children and anyone else who uses your account do, see, say, post, send, buy or experience on or through Lumi, including Lumi Circles, the Co-op Finder, Lumi Jobs and Lumi Bucks, and for any harm, loss or claim that results. This includes choosing which features your child may use and when; turning features on (such as the kids' room or typing) and deciding who your child may talk to; reading and supervising what your child sends and receives; keeping your Parent PIN secret; the accuracy of the ages and information you enter; and the safety and suitability of any activity, job, craft, experiment, outing or meetup you or your child chooses.
Your child's conduct is your responsibility. You are responsible for your child's acts and content on Lumi as if they were your own, and for any damage or claim they cause. If another person or family brings a claim about something your child did or said, you will deal with it and not Lumi.
You make the safety decisions. Lumi's filters, reports, parent controls and settings are tools to help you. They are not a promise that your child will not see or receive something inappropriate, and Lumi does not replace your supervision. You understand and accept that communicating online and meeting other people involves risks, including exposure to inappropriate content or contact from other users, and you assume those risks for yourself and your child.
Your decisions are yours. When you or your child choose to share anything, join a co-op, agree to a meetup, contact another family or take any action suggested by another user, that is your decision and your risk. Lumi does not recommend, endorse, vet or take responsibility for any user, co-op admin, family, meetup, post or message.
Authority to agree for your child. You confirm you are your child's parent or legal guardian and have authority to agree to these Terms and the rules of every feature on your child's behalf. You agree that this includes the arbitration, class waiver, release, limits of liability and assumption of risk in these Terms, to the fullest extent the law allows.
What this does not change. Nothing in this section excuses Lumi from any legal duty that the law says cannot be shifted to a parent, or limits any right you have under law that cannot be waived.
Lumi Academy (lumi-academy.org) offers the following plans:
Lumi High (lumi-academy.org/high, grades 9–12) is included free with every Lumi Academy plan, including the 48-hour free trial. Lumi High is not sold as a separate subscription: one Lumi Academy account covers Pre-K through 12th grade for every learner profile on the account, with one login and one parent dashboard. Accounts that already hold a previously offered Lumi High or Lumi Bundle subscription continue as originally agreed until cancelled.
Lumi Lingo (lumi-academy.org/lingo) is included free with every Lumi Academy plan. It is also available on its own, without Lumi Academy, as a separate subscription offering the following plans:
The Quarterly plan, the Annual plan and the earlier Lifetime Pass for Lumi Academy, and the Lifetime plan for Lumi Lingo, are no longer offered for new purchase. Members who already hold one of those plans, or who subscribed at a previously offered price, continue on that plan until they cancel or change plans. Prices shown inside the iOS app are set through Apple's In-App Purchase system and may differ from the prices on our website.
All payments are processed securely through Square, or through Apple's In-App Purchase system when subscribing from within the iOS app. We do not store your payment card information. Subscriptions renew automatically unless cancelled before the renewal date. To cancel a Square subscription, contact us at hello@lumi-academy.org; to cancel an Apple In-App Purchase subscription, manage it directly in your device's Settings → Apple ID → Subscriptions. Lumi Bucks, if you buy them, are sold only on the Lumi website (and by a link from the Android app that opens the website) and are not sold in the iOS app. See Section 5D.
Founding Family seats are numbered, limited seats offered to the first 1,500 new Lumi Academy memberships on any paid plan (monthly, quarterly, annual or lifetime) and, separately, the first 1,500 new Lumi Lingo memberships on any paid plan, started on or after October 8, 2026 (monthly and quarterly plans from October 9, 2026). Families who were already paying an annual or lifetime plan on October 8, 2026, or a monthly or quarterly plan on October 9, 2026, and complimentary or promotional access, do not receive a seat for that plan. Such a member who later moves to an annual or lifetime plan may qualify while seats remain.
A Lumi Academy seat provides access to every product released by YourSpace LLC under the Lumi brand while the seat is active. A Lumi Lingo seat provides access to every language and course added to Lumi Lingo while the seat is active. A lifetime seat remains active for as long as the product it relates to is offered. A monthly, quarterly or annual seat remains active only while that subscription remains active; if the subscription is cancelled or lapses, the seat is voided and released, and the same account cannot reclaim it. No seat is ever renumbered; when a seat is released, its number is given to the next family.
Features, extensions and add-ons, including Lumi Circles, are part of Lumi Academy and Lumi High and are not separate products. A seat does not promise that any feature, extension or add-on will continue, and we may change or end them under section 16F.
Seats are tied to the account that holds the plan and may not be transferred, sold or shared outside the household. If a product is discontinued, a seat does not extend access to that product. We may refuse or void a seat obtained through fraud or abuse. A seat is a recognition and access benefit only, and does not give any ownership interest in YourSpace LLC or Lumi.
Founding Family seat holders may be invited to share opinions on ideas through the Founders' Council. Participation is optional and advisory only. Votes and comments are input that the owner may consider; they do not bind YourSpace LLC, and nothing about the Council gives anyone a right, expectation or promise of any feature, product, change, benefit or reward. YourSpace LLC makes all product, pricing and business decisions in its sole discretion and may change or end the Council at any time. By submitting a comment you allow us to use it to improve our products without compensation. Votes are visible to us by seat number and are not shown to other members.
YourSpace LLC is never required to consult, notify or seek the approval of the Council, or of any seat holder, before adding, changing, improving, fixing, pricing, renaming, limiting or removing any feature, lesson, product, plan or policy. Asking the Council about one idea does not create a duty to ask about any other, and an idea we put to a vote may be built, changed, delayed or dropped regardless of the result. Any list of released ideas shown to members is informational only; it does not mean a vote or comment caused, or earned credit for, any release, and members have no claim to any feature, product or revenue.
The Lounge is an optional area for adult account holders only. It is not part of the educational service for children and is not intended for, directed to, or appropriate for anyone under 18. By entering the Lounge you confirm you are an adult account holder, and you agree to keep children from using or viewing it. Parents and guardians are solely responsible for supervising devices in their household.
Mature humor. In the Lounge, the Lumi characters speak in an adult comedic voice that may include sarcasm, teasing, jokes about parenting and everyday life. The Lounge is clean: it contains no profanity and nothing sexual. Humor is subjective: by entering the Lounge you accept that some jokes may be irreverent or not to your taste, and you can mute the characters or leave the Lounge at any time. All jokes are fictional comedy performed by fictional characters; names, characters and situations are invented for comedic purposes and are not statements of fact about, and are not intended to refer to, any real person or group. Nothing in the Lounge is advice of any kind.
Games are for entertainment only. Lounge games involve no wagering, no purchase, and no prize or anything of monetary value. Experience points (XP), levels and streaks have no cash value, cannot be exchanged, transferred or redeemed, and may be changed or reset at any time.
No warranty; limitation of liability. The Lounge is provided "as is" and "as available", may be changed, limited or discontinued at any time, and is subject to the disclaimers and limitations of liability in these Terms. To the fullest extent permitted by law, YourSpace LLC is not liable for any offense, distress or other harm arising from Lounge content or from a child accessing the Lounge through an adult's account or device. If you do not agree with this section, do not use the Lounge.
What Lumi Bucks are. "Lumi Bucks" or "Bucks" are a virtual in-app currency that lets a learner get optional items inside Lumi, such as pet accessories, room items and themes. Bucks are not money, are not legal tender, are not a bank balance or stored value, and have no cash value. They are a limited, revocable license to use a feature of the Services, not property, and no one owns Bucks or items in the way they own money or goods. Earning or buying Bucks does not give any right to any particular item, feature or product.
Earning Bucks. Learners can earn Bucks for free by completing lessons and activities and through Lumi Jobs. We set how many Bucks each activity gives and may set daily or other limits, and we may change earning rates and limits at any time. All lessons and learning content stay available without buying Bucks.
Buying Bucks. Where purchases of Bucks are offered, Bucks may be bought only by the parent or guardian who holds the account (an adult at least 18 years old), only through the Lumi website and, where offered, a link from the Android app that opens the website, and only with a payment method that belongs to that adult. Children may not buy Bucks. Payments are processed by Square under Section 5. Bucks are sold at a flat rate of 20 Bucks for $1.00 U.S., in the amounts shown at checkout, plus any applicable taxes. Bucks are not sold in, and purchased Bucks cannot be spent in, the Lumi iOS app.
Earned and purchased Bucks. We keep earned Bucks and purchased Bucks in separate balances. Inside the Lumi iOS app only earned Bucks can be used.
Parent controls. The account holder may set a monthly spending limit and may turn purchasing off at any time in the parent area. We may require the Parent PIN or other confirmation before a purchase. You are responsible for purchases made under your account, including by a child who uses a device where you are signed in.
No cash value; no transfers. Bucks and items cannot be exchanged for money or anything of monetary value, cannot be sold, traded, gifted, lent or transferred to another learner, account or person, and cannot be used outside Lumi. Any attempt to do so, and any attempt to get Bucks by fraud, automation, exploiting an error or a chargeback, is a violation of these Terms and may result in removal of Bucks and items and suspension or closure of the account.
All sales are final. Purchases of Bucks are governed by Section 6 (Refund Policy). If you believe you are entitled to a refund under applicable law, contact us at hello@lumi-academy.org. If a payment is reversed or charged back, we may remove the related Bucks and anything obtained with them.
Changes, items and availability. We may add, change, rename, reprice (in Bucks) or remove items, add or change earning rates and limits, and change how Bucks work. We will not change the number of Bucks you already hold or the real-money price you already paid for Bucks you have already bought. Items are not guaranteed to remain available. If we stop offering Bucks altogether, we will give reasonable notice in the app.
Balances when an account ends. Bucks do not expire while your account is active. If an account is deleted, Bucks and items are deleted with it and cannot be restored by us, other than through the 30-day recovery window described in our Privacy Policy. If we close an account for violating these Terms, the Bucks and items in it are forfeited.
No gambling. Bucks are not wagered, no item is obtained by chance, and there are no prizes of monetary value.
What Jobs are. Lumi Jobs lets a parent or guardian create household jobs, lets a learner mark them done, and lets the parent approve them. Approved jobs give the learner Bucks and XP, or add an entry to the allowance record, as the parent chooses. Jobs are set up and controlled by the parent; learners choose from the jobs the parent has made available.
Parents decide and supervise. The parent is solely responsible for choosing jobs that are safe and suitable for the child's age and ability, for supervising them, and for deciding whether to approve a job. Do not create a job that is dangerous or that involves anything unlawful. Jobs are family chores, not employment, and nothing in Jobs creates an employment relationship, wages or any legal obligation of YourSpace LLC to pay a child.
We do not hold or move money. The allowance record is a bookkeeping aid for the parent. YourSpace LLC does not hold, receive, send or pay out money to or for anyone through Jobs, is not a bank or money transmitter, and is not responsible for whether a parent pays or does not pay a child. Dollar amounts shown in the allowance record are the parent's own record, calculated at 20 Bucks of job value to $1.00, and are not a promise of payment by us. Tap "Mark paid" only after you have paid your child yourself.
Limits and changes. Bucks earned from jobs are subject to a daily limit per child that the parent can set within a range we allow. Jobs over the limit count the next day. We may change or end Jobs at any time. Jobs content you enter is your family's content; do not put personal information in job names or notes. Job data is stored in the parent's account and is deleted when the account is deleted.
What it is. Lumi Circles is a members-only community for paying Lumi families. Adult members can post in a global feed seen by all paying members, start or join private groups of Lumi families ("co-ops"), plan meetups, and talk with other parents. Where a co-op chooses to turn it on, and only with a parent's permission for each child, children aged 6 and over can take part in a separate kids' room inside that co-op.
Who can use it. You must be 18 or older and hold an active paid Lumi Academy or Lumi High account to use Circles as an adult. Free trials and Lumi Lingo-only accounts do not include Circles. We may pause or end your Circles access at any time, for example after reports or removals, without affecting your Lumi subscription. You agree to these rules each time you open Circles.
Your content. You are responsible for what you post. You give us permission to store and show your posts, replies, profile and contact card to the people who can see them (all paying members for the global feed; the members of a co-op for that co-op), and to keep a record of reported content as evidence. Anything you post in the global feed can be seen by every paying Lumi member, including people you do not know. Think before you share personal details such as phone numbers, email addresses, links, children's names, photos, school names or addresses. Do not threaten or encourage violence, harass, post hateful or unlawful content, post anything sexual involving children, or sell or advertise. Our automatic filters block some content, including threats, suicide and self-harm, slurs and strong profanity, and may not catch everything. If you are thinking about harming yourself, call or text 988 in the US, or call 911 in an emergency.
Children and kids' rooms. Children never have their own Circles account. A child takes part through their normal Lumi profile only after (a) an admin of the co-op switches the kids' room on and (b) the child's parent or legal guardian turns it on for that child inside the parent's account. Allowing a child to type messages needs a separate confirmation by the parent. Children appear only as a "Lumi friend" name, never with a real name or photo, and cannot send images, video, audio, files or private messages. Children's messages are checked by automatic filters before they appear, parents can read everything in the kids' room, and adults cannot write there. You, as the parent or legal guardian, are responsible for deciding whether your child takes part and for supervising their use. You can turn Circles off for your child at any time. Parent and admin controls and automatic filters help but cannot guarantee a child will never see inappropriate content.
No supervision. YourSpace LLC does not organize, vet, staff or supervise any co-op, meetup, or the families in them, does not run background checks, and does not monitor conversations in real time. Meeting other families is your choice and your responsibility. Meet in public places the first time. We are not responsible for what happens at or because of any meetup or conversation.
Co-op admins. Admins are other members, not Lumi staff. They decide who joins their co-op, can switch the kids' room on or off for their co-op, can see members' profiles, answers to join questions, and contact cards, can hide messages in the kids' room, and can remove members.
Reports, hiding and removal. Anyone can report content or a member. When something is reported, we may hide it immediately while it is reviewed, and it may stay hidden or be removed. Content that is reported by only one person may reappear after a review period if no one has acted on it. Serious reports, or reports from several families, can remove a member automatically. Repeated removals end Circles access. Lumi staff may review reported content and any content needed to keep Circles safe. We may share information with law enforcement or child-safety organizations where the law requires or allows it.
We may change or end Circles at any time. Lumi Circles, including the global feed, co-ops, kids' rooms, posts, messages, profiles and every other social part of Lumi, is an optional extension of Lumi Academy and Lumi High. It is a feature, not a separate product, and it is not part of what any plan or seat promises. We may change, pause, limit, move or permanently end any part of it, or all of it, at any time and for any reason, and we may delete any or all of the content and data in it. We have no duty to keep Circles running, to keep or return any content, or to bring a feature back, and ending or changing it gives you no claim against us. We are not responsible for losing posts, messages, co-ops, memberships or contacts made through Circles, so keep your own copy of anything you want to keep and stay in touch with other families in other ways if you wish. Ending or changing Circles does not by itself end your Lumi account, and your other Lumi features continue under these Terms. If we plan to end all of Lumi Circles, we will tell you by email and in the app at least 1 day before it ends. We may end or limit Circles, or any part of it, immediately and without notice where we think it is needed for safety, to follow the law, to deal with abuse or an outage, or to protect children.
Deleting your data. Deleting your Lumi account deletes your Circles profile, global feed posts and replies, memberships, join requests and sign-ups, your agreement records, and every kids' room link, card, message and reaction created through your children's profiles. Parents can also turn Circles off for a child, which removes that child's cards and messages.
All sales are final. Refunds are issued only where required by applicable law. If you believe you are entitled to a refund under the laws of your jurisdiction, contact us at hello@lumi-academy.org and we will review your request. This section also applies to purchases of Lumi Bucks.

All content across Lumi Academy and Lumi High — including lessons, characters, graphics, curriculum, and branding — is owned by YourSpace LLC and protected by copyright law. You may not reproduce or distribute any content without our written permission.
THE LUMI PLATFORMS, CONTENT AND ALL FEATURES, INCLUDING LUMI CIRCLES, ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT THE LAW ALLOWS. We do not promise that the services will be uninterrupted, secure or error-free, that content will be accurate or complete, that defects will be fixed, that automatic filters and safety tools will catch everything, or that any user, co-op, post or message is safe, truthful or suitable. We do not endorse or control what other users say or do. Some places do not allow some of these exclusions, so some may not apply to you.
TO THE FULLEST EXTENT THE LAW ALLOWS: (A) YOURSPACE LLC, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS AND AFFILIATES ("LUMI PARTIES") WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR EMOTIONAL DISTRESS, ARISING FROM OR RELATED TO THE SERVICES, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. (B) LUMI PARTIES ARE NOT LIABLE FOR THE CONTENT OR CONDUCT OF ANY USER, CO-OP ADMIN, CHILD OR OTHER THIRD PARTY, ONLINE OR IN PERSON, OR FOR ANY MEETUP, GATHERING OR ACTIVITY ARRANGED THROUGH THE SERVICES. (C) THE TOTAL LIABILITY OF ALL LUMI PARTIES FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (I) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (II) ONE HUNDRED U.S. DOLLARS ($100). These limits apply to every legal theory, including contract, negligence and product liability, and are an essential basis of our agreement and our pricing. They do not limit liability that the law does not allow to be limited, such as liability for fraud or for intentional wrongdoing. Some places do not allow some of these limits, so some may not apply to you.
Your responsibility. You are responsible for your own conduct and content and for how your children and anyone else using your account use Lumi. Some features, including Lumi Circles and the Co-op Finder, connect you with other people. Lumi does not organize, vet, staff, supervise or take responsibility for any co-op, meetup, message, post or activity between users, and does not run background checks. You decide whether, how, and with whom to connect, and you are responsible for checking the identity and suitability of anyone you meet or allow your child to talk to.
Release. To the fullest extent the law allows, you release the Lumi Parties from claims, demands and damages of every kind, known or unknown, arising out of disputes or interactions between you (or your children) and other users, co-op admins or anyone you meet through Lumi, and arising out of your or your children's use of Lumi, including your decisions to turn on, use or allow any feature.
Indemnity. You agree to defend, indemnify and hold harmless the Lumi Parties from any claim, demand, loss, liability, damage, cost or expense (including reasonable attorneys' fees) arising out of or relating to: (a) your or your child's use of Lumi, including anything your child does, posts, says or experiences, and any claim brought by or on behalf of your child, another child, or another family; (b) content you or your child post or send; (c) your breach of these Terms or any law; (d) any interaction, meetup, gathering or activity with another user or arranged through a Lumi feature; or (e) a claim that you gave us inaccurate information. We may take over the defense of a claim at our expense, and you agree to cooperate. You may not settle a claim in a way that admits fault for a Lumi Party or limits our rights without our written consent.
Lumi's lessons are written in advance and are not generated by artificial intelligence while your child is using them. Lessons, images, audio, voices, music and other materials may be created or edited with software tools, including tools that use automated technology. Our support chat also uses automated technology and can make mistakes. Despite our care, content can contain mistakes or may not match your standards or your child's needs. We do not guarantee accuracy, completeness or suitability. Review content with your child, use your own judgment, and tell us about errors at the address in section 17. We may correct or remove content at any time.
From time to time, YourSpace LLC may announce, plan, or offer promotional benefits, community events, in-person gatherings, trips, or other special perks ("Promotional Benefits") to qualifying subscribers of any Lumi platform. These Promotional Benefits are offered as discretionary, value-added perks at the sole election of YourSpace LLC and do not constitute a contractual obligation, guaranteed deliverable, or purchased service.
By participating in or relying on any announced Promotional Benefit, you acknowledge and agree to all of the following:
Any additional terms specific to a particular event will be communicated in advance and shall supplement (not replace) this section.
YourSpace LLC may invite individuals ("Creators") to promote Lumi using a unique referral code. Participation is entirely at our discretion and governed by this section.
Nothing in this section creates an obligation to accept any person as a Creator or to continue the program.
We may update these Terms. We will post the new version with its date and will email you about important changes at least 14 days before they take effect, unless a change is required immediately for legal or safety reasons. Some features may ask you to agree again before you continue (for example, Lumi Circles asks you to agree each time you open it). If you do not agree to a change, you must stop using Lumi before it takes effect and you may cancel your subscription; continuing to use Lumi after the effective date means you accept the new Terms.
Governing law. These Terms and any dispute between you and YourSpace LLC are governed by the laws of the State of Alabama, without regard to conflict-of-laws rules, and by U.S. federal law where it applies.
Talk to us first. Before starting any claim, you agree to email us at hello@lumi-academy.org with a short description and your contact details, and to give us 30 days to try to resolve it.
Arbitration. If we cannot resolve a dispute informally, you and YourSpace LLC agree that it will be decided by binding individual arbitration, not in court, conducted by a neutral arbitration provider under its consumer arbitration rules, except that (a) either of us may bring an individual claim in small-claims court if it qualifies, (b) either of us may go to court to stop infringement or misuse of intellectual property, and (c) nothing here stops you from reporting a concern to a government agency. The arbitrator decides any question about whether this section applies, and applies the law and the limits in these Terms. We will pay the filing, administrative and arbitrator fees that the provider's consumer rules require us to pay, and the arbitration may be held by video or phone, or in the county where you live. This section also covers claims you bring on behalf of your child.
No class actions or jury trial. To the fullest extent the law allows, you and YourSpace LLC each waive the right to a jury trial and the right to bring or take part in a class, collective, representative or consolidated action. Claims may be brought only on an individual basis. If this waiver cannot be enforced for a claim, that claim goes to court (not arbitration) and the rest of this section still applies.
30-day opt-out. You may opt out of arbitration and the class waiver by emailing hello@lumi-academy.org within 30 days after you first agree to these Terms (or to a change that adds this section), stating your name, your account email and that you opt out. If you opt out, disputes go to the state or federal courts in Limestone County, Alabama, and you and we agree to their jurisdiction.
Time limit. To the extent the law allows, any claim must be filed within one year after it arose, or it is permanently barred.
Consumer rights. Nothing in these Terms removes rights that the law of your state gives you and does not allow to be waived.
Your content. You keep ownership of what you post (including posts, replies, profile details, jobs, notes and messages). You give YourSpace LLC a worldwide, non-exclusive, royalty-free license to host, store, copy, display, and use that content as needed to run, protect and improve the services, to show it to the people you chose, to enforce these Terms, and to keep records of reported content. You promise you have the right to post it and that it does not break the law or anyone's rights. You may not post content that belongs to someone else, includes a child's personal details, or that you do not have permission to share.
We do not monitor. We are not required to review, screen, edit or remove content, we do not review content before or as it is posted, and we are not responsible for what any user posts or sends. We may, but are not obliged to, use automatic filters, review reports, hide or remove content, and suspend or end accounts at our sole discretion and at any time, with or without notice. Doing so does not mean we promise to catch or remove everything. We are not responsible for content or conduct we do not remove, or for any decision to remove or hide something. You acknowledge that Lumi is an interactive computer service and that other users, not Lumi, are the speakers and publishers of the content they post.
We respect copyright. If you believe something on Lumi infringes your copyright, send a notice to hello@lumi-academy.org that includes: your signature; identification of the work; where on Lumi the material is; your contact details; a statement of good-faith belief that the use is not authorized; and a statement, under penalty of perjury, that your notice is accurate and you are the owner or authorized to act for the owner. We may remove content and end accounts of repeat infringers. If your content was removed by mistake, you may send a counter-notice to the same address.
We may suspend, restrict or end your access to any or all of Lumi at any time, for any reason, including a safety concern, a report, a breach of these Terms, a payment problem, or a legal request, with or without notice. You may stop using Lumi and cancel your subscription at any time. Sections that by their nature should continue (including 4A, 5, 6, 8 to 11, 16 and 16A to 16F) continue after your access ends.
Lumi uses and links to services we do not control, including payment processors (such as Square), app stores (Apple and Google) and other websites. We are not responsible for them, and their terms apply to you. If you use a Lumi app downloaded from the Apple App Store: these Terms are between you and YourSpace LLC only, not Apple; Apple has no duty to provide maintenance or support; if the app fails to conform to an applicable warranty, you may tell Apple and Apple may refund the purchase price, and to the fullest extent the law allows Apple has no other warranty duty; we, not Apple, are responsible for claims about the app, including product liability, legal compliance and intellectual property claims; you confirm you are not in an embargoed country or on a U.S. restricted list; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Entire agreement. These Terms, our Privacy Policy and any rules shown for a specific feature are the entire agreement between you and YourSpace LLC about Lumi and replace earlier agreements. Severability. If part of these Terms cannot be enforced, the rest stays in effect. No waiver. Not enforcing a term is not a waiver of it. Assignment. You may not transfer your rights under these Terms. We may transfer ours, including to a successor in a sale or reorganization. Events outside our control. We are not liable for delay or failure caused by events beyond our reasonable control, including outages of internet, hosting, payment or app-store services, natural disasters, labor disputes, government action, or attacks on our systems. Notices and electronic agreement. You agree to receive notices from us electronically (email to your account address and posts on our site) and that clicking or ticking to agree is your signature. No third-party beneficiaries, except as stated in 16D. Headings are for convenience only.
Lumi Circles, including the global feed, co-ops, kids' rooms, posts, messages, profiles and every other social part of Lumi, is an optional extension of Lumi Academy and Lumi High. It is a feature, not a separate product, and it is not part of what any plan or seat promises. We may change, pause, limit, move or permanently end any part of it, or all of it, at any time and for any reason, and we may delete any or all of the content and data in it. We have no duty to keep Circles running, to keep or return any content, or to bring a feature back, and ending or changing it gives you no claim against us. We are not responsible for losing posts, messages, co-ops, memberships or contacts made through Circles, so keep your own copy of anything you want to keep and stay in touch with other families in other ways if you wish. Ending or changing Circles does not by itself end your Lumi account, and your other Lumi features continue under these Terms. If we plan to end all of Lumi Circles, we will tell you by email and in the app at least 1 day before it ends. We may end or limit Circles, or any part of it, immediately and without notice where we think it is needed for safety, to follow the law, to deal with abuse or an outage, or to protect children.
