It is NOT an accredited school, licensed educator, or certified curriculum provider of any kind. Using this app does not satisfy any legal homeschool reporting obligation in any state or country.

1. Nature of the Service

Lumi Academy ("the App," "we," "us," "our") is operated by YourSpace LLC, a limited liability company. The App is offered as an informal, supplemental, AI-powered educational entertainment platform — think of it as a very smart educational video game or interactive cartoon show, not a school. It is provided to families as a fun learning companion only. Nothing in the App constitutes formal instruction, tutoring, or academic advising.

2. Not an Accredited Institution

Lumi Academy is expressly NOT accredited by any federal, state, regional, or private accreditation authority — including but not limited to AdvancED, Cognia, WASC, NEASC, or any state department of education. Completion of content in this App does not constitute an official grade, academic credit, diploma, transcript, certificate, or any academic qualification recognized by any institution or employer. Do not rely on this App as your sole homeschool compliance mechanism. Parents are solely responsible for complying with their state's homeschool registration and reporting laws.

3. No Educational Warranties or Guarantees

While we strive to align content with broadly accepted K–8 and K–8 curriculum standards, YourSpace LLC makes absolutely no warranties, representations, or guarantees — express or implied — regarding the accuracy, completeness, appropriateness, timeliness, or suitability of any content for any child's educational needs. AI-generated content may contain factual errors, age-inappropriate suggestions, or incomplete information at any time. All content is provided strictly "AS IS" and "AS AVAILABLE" for entertainment and enrichment purposes only.

4. Broad Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOURSPACE LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages of any kind — including but not limited to: educational deficiencies or outcomes; developmental harm; psychological harm; data loss or corruption; service interruptions; errors in AI-generated content; subscription billing disputes; device damage; or any harm to any child or adult arising from use of or reliance on this platform. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE APP IS TO STOP USING IT.

5. Children's Privacy & COPPA Compliance

This App is designed to be used by children only under direct parental supervision and through a parent/guardian account. We do not knowingly collect personal information directly from children under 13. By creating an account, you represent that you are a parent or legal guardian (18+) who is creating the account on behalf of your child(ren). All data associated with child profiles is entered by you, the parent. You are solely responsible for supervising your child's interactions with the App and any AI-generated content they encounter. If you believe a child under 13 has provided personal data without parental consent, contact us immediately.

6. Microphone & Voice Data

Some interactive lessons use your device's microphone for real-time speech recognition to evaluate a child's verbal responses. Microphone access is requested only during active voice-response activities. Speech audio is processed by the device's built-in speech recognition engine or a third-party speech API and is not recorded, stored, or retained by YourSpace LLC beyond the immediate recognition event. We do not build voice profiles or retain audio recordings of children.

7. AI-Generated Content Disclaimer

Lesson content, stories, quizzes, hints, and feedback are generated in real time by third-party artificial intelligence models, including Anthropic's Claude API. This content is algorithmically produced and not individually reviewed by a qualified educator before display. AI systems can and do produce inaccurate, outdated, or contextually inappropriate content. YourSpace LLC disclaims all responsibility for errors, omissions, or any harm arising from AI-generated content. Parents are encouraged to review lessons alongside their children and correct any errors.

8. Subscriptions, Billing & Refunds

Lumi Academy offers multiple subscription tiers, including monthly, annual, and a one-time Lifetime Access Pass. All subscription fees are charged at the start of each applicable billing cycle or at the time of purchase and are non-refundable for any partial, unused, or remaining period. Monthly and annual subscribers may cancel at any time through their account settings; cancellation takes effect at the end of the current paid period with no pro-rated refund. YourSpace LLC reserves the right to modify pricing at any time with 30 days' advance notice. Continued use of the App after a price change constitutes acceptance of the new rate.

8A. Lifetime Access Pass — Special Terms

What "Lifetime" Means. The Lumi Academy Lifetime Access Pass ("Lifetime Pass") grants access to Lumi Academy for the operational lifetime of the product — meaning for as long as YourSpace LLC continues to actively operate and maintain the Lumi Academy platform. "Lifetime" refers strictly to the life of the product and YourSpace LLC's decision to continue offering it. It does NOT mean the purchaser's lifetime, their child's lifetime, or any guaranteed minimum period of service. YourSpace LLC makes no warranty, representation, or guarantee of any minimum duration of service.

Included Features. The Lifetime Pass covers up to eight (8) child learner profiles on a single parent/guardian account. It includes access to Pre-K through 8th grade curriculum content available within the App at any given time, all currently included bonus subjects and elective content, and all future features added to the platform during its operational life. Feature availability is at YourSpace LLC's sole discretion and may change at any time.

ALL SALES ARE FINAL — NO REFUNDS. The Lifetime Access Pass purchase is entirely and unconditionally non-refundable under all circumstances, including but not limited to: change of mind; dissatisfaction with content; technical issues; changes to features or pricing; service interruptions; product discontinuation; account suspension or termination; or any other reason whatsoever. By completing a Lifetime Pass purchase you expressly acknowledge and agree that no refund of any amount will be issued under any circumstances.

Chargeback & Payment Dispute Policy. Initiating a chargeback, payment reversal, or dispute of any kind through your bank, credit card issuer, payment processor, or any other financial institution in connection with a Lifetime Pass purchase constitutes a material breach of these Terms. Upon initiation of any such dispute, YourSpace LLC reserves the right to immediately and permanently suspend or terminate your account, all child profiles, and all associated access — with no obligation to restore access regardless of the outcome of the dispute. You agree to contact YourSpace LLC directly at our official support contact before initiating any payment dispute.

Account Suspension, Downgrade & Termination. Lifetime Pass benefits are subject to forfeiture and your account may be suspended, downgraded, or permanently terminated — without refund and at YourSpace LLC's sole discretion — for any of the following: (a) violation of these Terms of Use or Acceptable Use Policy; (b) use of unauthorized means to access the App, including hacks, exploits, credential stuffing, or manipulation of subscription status; (c) sharing, reselling, or distributing account access to individuals outside your immediate household; (d) circumventing billing or feature-gating mechanisms; (e) abusive, threatening, or fraudulent conduct toward YourSpace LLC, its staff, or other users; (f) any activity YourSpace LLC reasonably determines to be harmful, abusive, or contrary to the spirit of a personal family subscription; or (g) any other reason YourSpace LLC deems necessary in its sole and absolute discretion to protect the integrity of the platform. Termination for any of the foregoing reasons will result in permanent forfeiture of the Lifetime Pass with no refund, credit, or compensation of any kind.

Product Discontinuation. YourSpace LLC reserves the right to discontinue, sunset, or permanently shut down the Lumi Academy platform at any time, for any reason, at its sole discretion. In such an event, Lifetime Pass holders will receive no refund, credit, or compensation of any kind. This risk is inherent in and material to the nature of a "lifetime of the product" access model, and purchasers expressly acknowledge and accept this risk at the time of purchase.

Non-Transferability. The Lifetime Pass is personal to the purchasing account and is non-transferable. It may not be sold, gifted, assigned, or otherwise transferred to any other individual, family, or entity. Any attempt to transfer access will result in immediate termination of the Lifetime Pass without refund.

9. Acceptable Use

You agree to use this App solely for its intended purpose of informal family learning and entertainment. You will not: (a) attempt to reverse-engineer, decompile, or scrape the App or its AI systems; (b) resell or redistribute App content; (c) use the App for commercial tutoring services; (d) attempt to circumvent subscription or access controls; (e) submit false or misleading information during account creation; or (f) use the App in any way that violates applicable law. Violations may result in immediate account termination without refund.

10. Intellectual Property

All App code, design, characters, curriculum structure, and branding are the property of YourSpace LLC and are protected by applicable copyright, trademark, and intellectual property laws. User-generated content (drawings, saved work) remains the property of the user. By using the App, you grant YourSpace LLC a non-exclusive, royalty-free license to store and display your child's in-app work solely to deliver the service.

11. Indemnification

You agree to indemnify, defend, and hold harmless YourSpace LLC and its members, officers, employees, and agents from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising from: (a) your use or misuse of the App; (b) your violation of these Terms; (c) your child's use of the App under your account; or (d) your violation of any applicable law or third-party right.

12. Dispute Resolution & Arbitration

Any dispute arising from or relating to these Terms or your use of the App shall first be attempted to be resolved informally by contacting us. If unresolved within 30 days, disputes shall be resolved by binding individual arbitration under the rules of the American Arbitration Association. YOU WAIVE ANY RIGHT TO A JURY TRIAL OR CLASS ACTION PROCEEDING. Arbitration shall take place in the state in which YourSpace LLC is registered. Small claims court actions are exempt from this provision.

13. Governing Law

These Terms are governed by the laws of the state in which YourSpace LLC is registered, without regard to conflict-of-law principles. You consent to the exclusive jurisdiction of courts located in that state for any disputes not subject to arbitration.

14. Termination

YourSpace LLC reserves the right to suspend or terminate any account at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion. Upon termination, your access to the App will cease and any stored child data may be deleted after a 30-day grace period.

15. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated via the App or email. Continued use of the App after changes constitutes acceptance. The most current version is always available at lumi-learning.web.app.

16. Force Majeure

YourSpace LLC shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: natural disasters, internet outages, third-party API failures (including Claude/Anthropic services), government actions, or other force majeure events.

17. Lumi Family Day 2027 — Event Terms & Conditions

Event Overview. Lumi Academy has announced Lumi Family Day 2027, a planned community event in Gatlinburg, Tennessee. The official event is intended to include one (1) Dollywood admission day and one (1) Dolly Parton's Stampede dinner and show package for qualifying attendees. This event is a special benefit offered to qualifying paid Lumi members and is subject to all conditions stated below.

Minimum Participation Threshold — Event Activation. Lumi Family Day 2027 is contingent upon Lumi Academy reaching and maintaining a minimum subscriber base prior to the event. The event will only be activated and proceed if at least 275 active annual memberships OR at least 2,500 active monthly subscriptions are current and in good standing at the time of event confirmation. If this threshold is not met, the event may be postponed, modified, or cancelled at YourSpace LLC's sole discretion. No compensation, credit, or refund will be owed to any member in the event of cancellation or postponement due to failure to meet this threshold.

Individual Eligibility. To qualify for participation, a member must: (a) hold an active paid annual Lumi Academy subscription in good standing at the time of event registration; (b) meet any minimum tenure or activity requirements as determined by YourSpace LLC; (c) complete any required verification process; and (d) register within the designated registration window. Eligibility is subject to verification and is determined solely at YourSpace LLC's discretion. Monthly subscribers do not qualify for individual participation — this benefit is for annual members only.

Capacity & Availability. Total attendance is strictly limited to 275 attendees. Spots are first-come, first-served among qualifying members once registration opens. Meeting eligibility requirements does not guarantee a spot. YourSpace LLC reserves the right to adjust capacity, attendance limits, or qualification criteria at any time.

What Is Included. For confirmed qualifying attendees, Lumi Academy will cover: (a) official event admission for the designated Dollywood day; and (b) the Dolly Parton's Stampede dinner and show package for the designated event date. No other costs are included.

What Is NOT Included. The following are expressly not covered by Lumi Academy and remain solely the responsibility of the attending family: lodging; travel; transportation; gas; parking; airfare; meals outside the included show package; souvenirs; merchandise; any additional Dollywood tickets or upgrades; travel insurance; and any other personal expenses of any kind.

Event Details & Changes. All event details — including exact dates, venue specifics, package inclusions, and logistics — are still being finalized and are subject to change. YourSpace LLC makes no guarantee that specific dates, packages, or arrangements will remain as currently described. Material changes will be communicated to qualifying members. YourSpace LLC is not liable for any travel or lodging costs incurred based on preliminary event information that is subsequently changed.

No Transferability. Event participation is non-transferable. Spots may not be sold, gifted, or transferred to any other individual or family. Any attempt to transfer a spot will result in forfeiture without compensation.

Liability. YourSpace LLC's liability in connection with Lumi Family Day 2027 is strictly limited to the direct cost of the included event admissions. YourSpace LLC is not responsible for any injury, loss, theft, illness, accident, or other harm occurring during travel to, from, or at the event. Attendance is entirely at the participant's own risk. All venue rules, policies, and terms of the respective attractions apply. YourSpace LLC is not affiliated with or endorsed by Dollywood, Dolly Parton's Stampede, or any affiliated Herschend Family Entertainment entity.

Cancellation & Rescheduling Rights. YOURSPACE LLC EXPRESSLY RESERVES THE ABSOLUTE AND UNCONDITIONAL RIGHT TO CANCEL, POSTPONE, RESCHEDULE, MODIFY, OR DISCONTINUE LUMI FAMILY DAY 2027 AT ANY TIME, FOR ANY REASON OR NO REASON, WITH OR WITHOUT NOTICE, AT ITS SOLE AND ABSOLUTE DISCRETION. Reasons may include but are not limited to: failure to meet the minimum participation threshold; venue unavailability; vendor cancellation; business circumstances; financial considerations; acts of God or force majeure; changes in applicable law; safety concerns; or any other factor YourSpace LLC determines in its sole judgment. In the event of cancellation or rescheduling: (a) YourSpace LLC shall have zero financial obligation to any member or attendee beyond the face value of any admission costs directly paid by YourSpace LLC on a confirmed attendee's behalf; (b) YourSpace LLC shall not be liable for any non-refundable travel, lodging, transportation, or any other costs incurred by any attendee or prospective attendee in anticipation of the event, regardless of when those costs were incurred or whether the event was previously confirmed; (c) no membership refunds, credits, or compensation of any kind shall be owed as a result of cancellation or rescheduling; and (d) rescheduling to a new date shall not obligate YourSpace LLC to honor any previously issued spot confirmations if new qualification requirements are established for the rescheduled event.

No Binding Promise. Nothing in these Terms, in any marketing materials, social media posts, announcements, emails, or verbal communications from YourSpace LLC or its representatives constitutes a binding legal commitment to hold Lumi Family Day 2027. This event is aspirational and promotional in nature. Any and all statements about the event — including dates, inclusions, location, and eligibility — are subject to change at any time without liability. Members who make travel, lodging, or other arrangements based on preliminary event information do so entirely at their own risk.

Other Terms. Additional terms and conditions may apply and will be provided at the time of registration. YourSpace LLC reserves the right to modify any aspect of this event program at any time for any reason. This section does not constitute a binding contractual commitment to hold the event and is subject to all conditions herein being met.
